Swag Club Terms & Conditions

Swag Club Loyalty Program 

Swag Club is a free customer loyalty program (the “Program") offered by Kazoo Pet Co ("Company") to customers making purchases, and to potential customers, on kazoo.com.au.  

Members' Acceptance of Terms 

By opting in to the Program you agree to the Terms and Conditions set out here and in our Privacy Policy, Cookie Policy, and Website Terms of Use. If you are under 18 years, you must have parental/guardian approval to opt in to the Program, and further your parent/guardian must read and consent to these Terms and Conditions. Please read these Terms and Conditions and policies carefully before you use and/or opt in to the Program. 

Company will extend certain perks and privileges as described in more detail herein, and additional offers may be extended from time to time. These terms and conditions (hereinafter "Terms and Conditions") form the agreement (the "Agreement") between you ("Member") and Company with respect to the Program. 

By participating in the Program, Members agree to the terms and conditions, rules, regulations, policies and procedures of the Program, including, without limitation, these Terms and Conditions.. Each Member is responsible for remaining knowledgeable about the Program Terms and Conditions. Company reserves the right to disqualify Members who have violated any of the Program Terms and Conditions. 

Membership Eligibility 

The Program is open to Australian and International residents. Membership is limited to individuals only and is limited to one account per individual. Membership is not available to corporations, businesses, charities, partnerships, enterprises or anyone other than an individual, unless written approval is received in advance from Company, in its sole and absolute discretion. 

Membership Enrollment 

Individuals can enroll in the Program by creating an account at kazoo.com.au. Member must provide information accurately and completely when creating an account. Company reserves the right to refuse membership to any customer who does not follow the enrollment procedures. Member should promptly advise Company of any changes to their personal account contact information, such as name, and/or email address, by visiting kazoo.com.au and updating their Member account. 

Valid Email Address 

A current, valid email address is required for a Member to be eligible for select benefits, offers and updates. Member must notify Company of change of email address by updating Member account information online. 

Program Communications 

Company will communicate with Members about marketing via mail, email, SMS and other channels, including about special Member promotions, offers and more.   

Company will also use these channels to notify Member of eligibility for a benefit, benefit expiry, communicate Program changes and more. Please note that even if you opt out of receiving marketing or promotional communications, Company may continue to send you non-marketing or non-promotional emails, such as those about your account or our ongoing business relations. Company is not responsible if you don’t notify us of any change of details, which may result in you not obtaining any benefit or the loss or expiration of any member benefits.

Membership Tiers; Earning and Redeeming Rewards Points 

Membership Tiers Generally 

There are four tiers of membership in the Program:  

  • Level 1 Pal 
  • Level 2 Furriend 
  • Level 3 Compawnion 
  • Level 4 Pawtner 

Achieving Level 2, 3 or 4 status requires meeting a minimum spending threshold, as explained below.  

All membership tiers enjoy a variety of benefits made available by the Company in its sole discretion from time to time (“Benefits”). Benefits may vary by tier and some tiers may have more Benefits than others. The type, timing and availability of any Benefits (including Rewards, as defined below, special offers, one-of-a kind experiences, exclusive events, and/or advance access to products) will be determined by the Company in its sole discretion. All benefits offered to Members at any time are subject to change. 

Company may, in its sole discretion, alter, limit, or modify the tier rules, regulations, benefits, eligibility for membership, or any other feature of a particular tier or may terminate a particular tier at any time in its sole discretion, without prior notice except as expressly set out in these Terms or required by applicable law. 

Swag Club Level 1 Pal Member 

All members automatically become a Swag Club Level 1 Pal Member upon enrollment. Subject to removal from the Program (as explained below), a member will remain a Level 1 Pal Member indefinitely unless the minimum spending required to achieve Level 2, 3 or 4 Members status is met. Members will be enrolled in the highest tier available based upon their lifetime spend. 

Swag Club Level 2 Furriend Member 

Swag Club Level 2 Furriend Member status is granted to members who spend a minimum of $200 on merchandise from kazoo.com.au in thier lifetime as a member. Swag Club Level 2 Furriend status is retained once qualified, and does not revert to previous levels there after, regardless of future spend levels.  

Swag Club Level 3 Compawnion Member 

Swag Club Level 3 Compawnion Member status is granted to members who spend a minimum of  $500 on merchandise from kazoo.com.au in thier lifetime as a member. Swag Club Level 3 Compawnion Member status is retained once qualified, and does not revert to previous levels there after, regardless of future spend levels. 

Swag Club Level 4 Pawtner Member 

Swag Club Level 4 Pawtner Member status is granted to members who spend a minimum of  $1,000 on merchandise from kazoo.com.au in thier lifetime as a member. Swag Club Level 4 Pawtner Member status is retained once qualified, and does not revert to previous levels there after, regardless of future spend levels. 

Membership Level Upgrades 

Membership levels will be automatically upgraded once the next tiers qualifying spending threshold is met. Members will be notified on this level upgrade via email. 

Earning Swag Points 

Earning Program Swag Points (“Credit”) is based solely on a customer’s total dollar spent using the email address registered with a loyalty account on kazoo.com.au. 

The criteria for earning credit is as follows and is subject to change at any time: 

Under the Program, each tier of membership will have 10 reward points credited to their account for every $1 AUS dollar spent (a “Swag Point”) at kazoo.com.au. Points are only earned on your final product price, and not earned on discounts and postage or shipping costs. 

Eligible Purchases 

Purchases of merchandise and/or services, after promotional offers have been applied, before shipping charges have been applied, made at kazoo.com.au count toward your Program points. Additional items may be excluded from Tier Level accumulation at the sole discretion of Company. 

Returns 

Merchandise returns must be made in accordance with Company's return policy available at Returns and Refunds. Upon the return of an item, the spend amount applied to Program credit status for the original purchase will be deducted from the Member's account. 

Redeeming Swag Cash 

Credit is redeemed by converting Swag Points into Swag Cash. 

To redeem, Members can convert thier Swag Points into Swag Cash, that can then be applied to their next purchase through the use of a unique discount code. 

One (1) Swag Point is equal to $0.01 cents. There is no minimum amount of points required to redeem Swag Cash. Members must redeem their points on their Swag Club Rewards Page. The Swag Cash value redeemed is then applied via a discount code (found on your Swag Club Rewards Page) or by “applying” available credit on the Cart page when checking out. 

Once a purchase is made, you are unable to retrospectively apply any credit that was not used due to not applying via the code or redeeming at the cart.  

Swag Points Expiration 

It's our hope that you redeem your Swag Points on a regular basis. All unredeemed Swag Points will expire 12 months from the date of issue.  You’ll receive a notification reminding you to use them before they expire. If you have questions regarding the date of your last Swag Point activity or your last purchase, please consult your account page, or if you feel your Swag Points have expired in error, please email our Customer Service team for assistance. 

Additionally, Swag Points will automatically expire if your Membership is revoked or otherwise canceled for the reasons further set out in the Members' Acceptance of Terms and Right To Revoke, Termination and/or Removal from Program. 

 

Referral Program 

Qualified Referral

A Qualified Referral is defined as a purchase made at kazoo.com.au by a person (a “Referred Customer”) who arrives to our website by clicking your Referral Program link. You are limited to one Qualified Referral for each Referred Customer; in other words, additional/repeat purchases made by a Referred Customer are not counted as additional Qualified Referrals. 

Referred Customer

The Referred Customer and the Referrer cannot be the same person (for example, by using a different email address). The Referred Customer must be a new customer to the Site. The Referred Customer must use the $10 referral coupon code, and only one code per order. 

Referral Rewards.

For you to earn referral rewards as a Referrer, the Referred Customer must complete an order at kazoo.com.au. The Referrer may only use one $10 code per order. Referral rewards are not able to be combined with any other promotional codes, loyalty points, or special sales. Once a purchase is made, you are unable to retrospectively apply any referal credit that was not used due to not applying via the code or redeeming at the cart. 

Eligibility. 

Eligibility is limited to individuals only. Swag Club’s Referral Program cannot be used by businesses for affiliate lead generation. 

No Spam. 

You must comply with all up-to-date “SPAM” laws. For example, emails must be created and distributed in a personal manner and bulk email distribution is strongly discouraged. Any distribution of your referral link that could constitute unsolicited commercial email or "spam" under any applicable law or regulation is expressly prohibited and will be grounds for immediate termination of your account and exclusion from Swag Club Referral Program. 

Right to Close Accounts.

Company reserves the right to close the account(s) of any Referrer and/or Referred Customer and to request proper payment if the Referrer and/or Referred Customer attempts to use the Swag Club Referral Program in a questionable manner, breaches any of these terms and conditions, or is in violation of any law, statute or governmental regulation. 

Right to Cancel Program or Change Terms.

Company reserves the right to cancel the Referral Program or to change these terms and conditions at any time in its sole discretion. Any unclaimed referral rewards will be forfeited at that time. 

 

Additional Rewards 

Additional rewards and program perks may be made available from time to time.  Any rewards, gifts, benefits or offers communicated as part of the Program may include specific offer terms and conditions, including expiry dates and redemption conditions. You should read these Terms and Conditions carefully. Only Rewards Program members who receive our email communications are eligible to use and redeem any rewards, gifts, benefits or offers. All offers, gifts, benefits or rewards are not transferable and cannot be redeemed for cash or equivalent. 

All reward gifts, benefits or offers are subject to availability. We are not liable for any rewards, gifts, benefits or offers not being available for any reason. We reserve the right to change or withdraw the rewards and giveaways and these terms at any time without notice. 

Company's Right To Change/Cancel Program 

Company may alter, limit, modify or terminate the Program, the Program structure, any other feature of the Program, or these Terms and Conditions in its sole and absolute discretion at any time and in any manner without notice. Your continued participation in the Program will confirm your acceptance of such changes and any new terms. 

Right To Revoke, Termination and/or Removal from Program 

Company reserves the right to revoke the membership of any Member in the Program and/or revoke any or all benefits the Member may be entitled to, if in the sole and absolute discretion of Company, a Member abuses any of the Program privileges, fraudulently uses the Program, fails to comply with these Terms and Conditions or otherwise earns benefits through deception, forgery and/or fraud. 

No Transfer 

Program benefits may not be transferred, purchased, sold, assigned, auctioned or traded, including, without limitation, by death or as part of a domestic relations matter. Doing so will void the Member account. Benefits are site credits and not exchangeable for cash. 

Intellectual Property 

All Program design, text, graphics, logos, images, titles, phrases and product names and the copyrights, trademarks, service marks, trade dress and/or other intellectual property in such materials are owned by the Company.
